That’s a simple comment in here about Dr.WES’s post :A Conversation legal morass caused by emr :
It could happened with Paper records , same as EMR . however , I believe Lawyers somehow are like mosquitoes as in ( Bee Movie ) , will seek more and more of the data beyond their needs to use in their case . As in an old case i remember the judge ordered the whole paper records to be reviewed by a special city employment , and never handled them to the lawyers .
I remembered this case ,cause i believe the permission of the Medical Record is beyond the lawyers . and the patient himself . The patient can use only his own data , and even if his data is requested in a court root , it should be assigned to a group reviewed for these cases not the lawyers or even the public defender .
Back to the old discussion and issue , are there enough rules/laws to respect , protect , and reuse MR and/or EMR in such cases ?
Here in Egypt , We have a massive amount of paper records , so as Medical records , however there is no rules . but here as some cases already happened the judges are always asked for a copy of the certain records assigned to the case which mainly do not gets it , and if they do , the records examined by a certain people assigned by the judge to do such review .
